The ways in which a personal injury might occur are almost endless. However, the basic principles of personal injury law remain unchanged from case to case. Specifically, injury victims can hold parties accountable when said parties cause them harm negligently or otherwise unlawfully.
At Holland Injury Law, our injury attorneys are adept at taking on all categories of personal injury cases. Below are some of the types of cases we regularly work with.
Traffic is where a large percentage of personal injuries and fatalities occur, including serious crashes involving commercial trucks. Jackson County, home to Independence and the dangerous I-70, is the deadliest county in Missouri for drivers, with over 100 annual traffic fatalities each year.
We help our clients recover proper compensation payouts from unwilling insurance companies and defendants who try to pay less. Our experience informs our case evaluations and allows us to precisely identify your compensable losses and effectively fight to recover them.
Premises liability cases involve injury victims who are harmed on the property of others. In many instances, the harm and losses people suffer on someone else’s property are compensable, depending on the circumstances.
An invitee is owed the highest degree of care when on someone else’s land. Property owners or tenants must take reasonable steps to prevent the invitee from being harmed by a known hazard on the property. If the hazard is not known but should be known, the property owner could still be held liable for a consequent accident.
Invitees include parties present on a property for the benefit (typically financial) of the property owner. For example, a shopper at a corner grocery would be considered an invitee.
Licensees, on the other hand, are owed a lower degree of care than invitees. Licensees are parties who visit a property for primarily social, non-business reasons. The following parties, for example, would be considered invitees:
Construction accidents are a principal cause of injuries in Missouri.
Although workers’ compensation covers many of the injuries suffered by construction workers, some injured workers may be entitled to seek compensation from other sources, such as from a third-party lawsuit. When someone other than a member of the workplace causes a worker to be injured, that worker can sue the party who injured them for full damages.
Workers’ compensation only provides limited economic compensation for work injuries, but third-party lawsuits allow workers to pursue full damages, including non-economic damages like pain and suffering.
With the number of dogs at Pitcher Dog Park and out for walks around Independence these days, it is no wonder that dog bites occur sometimes.
In some cases, catastrophic injuries and death are the outcomes of dog attacks. Fortunately, Missouri law favors victims over dog owners.
According to Missouri’s dog bite statute, dog owners (or handlers) may be held strictly liable for damage caused by their dogs’ bites. Strictly liable means the victim need not show the owner was careless, negligent, or reckless. They need only show that the owner’s dog bit them.
For dog attacks not involving dog bites, victims may not use the dog bite statute. Instead, they can find relief in common law through a negligence lawsuit, where they must prove the owner was negligent or reckless.
At Holland Injury Law, we understand the impact of catastrophic injuries and fatalities and work diligently to recover the funds our clients will need for the future. We work closely with victims and family members in these cases to ensure they have the representation and support they need to weather this tough time.
If you have been harmed by someone else and have a valid claim for compensation, you should know that there is a statute of limitations that controls personal injury claims. In most cases, injury victims seeking to collect damages from a liable party must take legal action within five years.
Although five years seems like a long time, you should be aware of the effect of time on personal injury cases. Time can turn the strongest case for compensation into a weak claim. The more time that passes after an incident, the more likely it is that evidence problems will arise.
Witnesses’ testimony, for example, frequently becomes muddled soon after an incident. Additionally, certain types of valuable hard evidence disappear or become unavailable as time marches on. For example, video footage is frequently erased to make room for more footage. Swift action can help preserve such evidence before it is deleted.
Personal injury damages are meant to help make injury victims whole. They are categorized by the various losses victims suffer after being harmed by someone else.
In some personal injury cases, victims may be entitled to seek punitive damages. However, they must prove that the party that harmed them did so with fraud, malice, or intentional conduct.
