How Do Disability Benefits Work?

If you are expected to recover and your injury is classified as temporary, you can receive benefits proportional to your level of temporary disability. If the injury leaves you completely unable to work, you can collect temporary total disability benefits for up to 400 weeks. Usually, pay is about two-thirds of your average weekly wage, with some case-specific restrictions.

If your injury allows you to work but at a lower capacity (and therefore a lower wage), you may be able to collect temporary partial disability benefits for up to 100 weeks. Generally, these benefits are two-thirds of the difference between your pre-injury weekly wages and your current weekly wages.

Permanent disability benefits work much the same way and can be classified as either total or partial. In both cases, payments would be about two-thirds of your average weekly wage.
